ARTICLE 1
ORGANISING COMPANY
Thales, a company with registered capital of € 515 729 589, listed on the Nanterre Commercial Registry under number 552 059 024, with Head Office at 45, rue de Villiers, 92200 Neuilly-sur-Seine, France, acting at the behest and best interests of its legal representatives, based in that capacity at the aforementioned head office,
is organising, from 1 October 2008, on its Web site www.thalesgroup.com, a free competition with no purchase required, to play up its managerial and technological strategy “Moonshield”, introduced and made available on this same site, entitled:
" MOONSHIELD”
The game is structured into several sessions. Each game session has its own specific winnings, applicable period and scope, to be set out in successive to the addenda herein.
ARTICLE 2
ENTRANTS
For each session held, the game shall be open to any person above age 18, provided they comply with the requirements set out for the session and specified in the relevant addendum, the unwaivable exception being employees of the Organising Company and members of Companies acting as partner to the operation, as well as their family.
As an illustration, the Organising Company shall offer so-called “open” sessions, in which the general public shall be able to participate, or sessions referred to as “private”, intended for a limited audience, pursuant to a partnership with universities or schools.
Any participant at least 18 years of age must have the prior consent of a parent or guardian in order to participate in the Game and agree to the following rules.
The Organiser reserves the right to ask that the participant provide proof of the said consent and disqualify any participant or winner should that proof of consent be lacking.
In any event, the participant shall be required to provide a valid e-mail address.
ARTICLE 3
HOW TO ENTER
In order to take part in the game, Internet users are invited to go to www.thalesgroup.com and fill out a registration form (*surname, *name, *complete mailing address with zip code/city/country), and *e-mail address. The fields marked with an asterisk are mandatory. Once this form has been completed, the Internet user shall be asked to enter a user name and password, to be used for all subsequent connections to the Moonshield game.
Game Concept:
MOONSHIELD is a managerial and technological strategy game, which propels the player into the near future, where he must use THALES technologies to defend and protect the Earth from a wash of meteorites that is threatening civilisation.
Background:
The player is the leader of a moon base and is responsible for developing and extending it in order to cope with the threat of meteorites, NEOs (Near-Earth Objects), which must be destroyed before they reach the Earth. The game becomes increasingly difficult as the player’s abilities increase. The farther the player goes in the game, the greater the risk that meteorites fall and the better-suited the player’s response must be.
The player begins the game with an initial supply of 250 Building Material units, a currency of sorts that is valid within the game’s world.
The Objective:
The player learns about THALES and its activities by using its technologies in a fun and dynamic manner. The player will have to use THALES’ technologies, systems and products in order to build and manage the base, and detect and destroy meteorites. Videos showing Group experts appear during the game to explain how to use THALES’ technology in an optimal manner.
In any case, the player’s prime objective is to post the best score possible.

Scoring:
The player attempts to score as high as possible, through the following:
· Each NEO (Near Earth Object) is assessed according to a Level of Threat ranging from 1 to 450.
· When an NEO is partially thrown off course, its Level of Threat is lowered.
· When an NEO is fully thrown off course, the number of points won is 500 x Level of Threat.
· Whenever a building is erected for the first time, an additional Thales technology becomes available to the player.
· For every technology made available, an extra 1,000 points is added to the score.
· Each building costs between 40 and 1 200 Building Materials.
· For each Building erected, a number of points equal to the Building Cost is added to the score.
Note: the buildings present at the start are not taken into account in the score.

Rankings:
The best score posted by a player is listed in the top scores table (Hall of Fame).
The highest score is shown at the top (Number 1 position).
The lowest score is shown at the bottom (Number X position).
Any ties eliminate the positions just below them.
(e.g., if two players tie for 5th place, the next player will be ranked 7th)

Following each game session, the organising company shall identify the 15 highest scores and a drawing will be held under the supervision of a judicial officer to determine the winner(s) from that session.
ARTICLE 4
DETERMINING THE WINNERS
A drawing carried out under the supervision of SCP Simonin, Le Marec and Guerrier will determine who, out of the participants having posted the 15 top scores, will be the winner(s), as defined in the relevant addendum.
All point totals return to zero with the start of each new game session.
Should cheating be identified, all fraudulent participation shall be considered null and void and will not be taken into account, leading to the cancellation, automatically and by operation of law, of any winnings possibly earned.
Should the information provided by a participant be incomplete, that person shall not be registered and the organising company reserves the right to disregard, by operation of law, any participation by that person, without that person’s being able to make any claim whatsoever.
ARTICLE 5
PRIZES
For each game session, the description and value of the prizes offered will be set out in an addendum to be attached to the Rules herein.
Under no circumstances shall a financial counterpart be granted in lieu of the prize offered, which shall likewise be neither exchangeable nor returnable. The Organising Company shall be able to replace one (or more) of the prizes announced by another (or other) prize(s), should circumstances beyond its will so require.
The game winner or winner(s) shall receive their prize(s) by mail, at the address listed on the registration form. Should that address be false, the returned prize shall remain the property of the Organising Company.
The Organising Company’s liability shall be limited to the prize alone and shall, under no circumstances, be incurred, regardless of the incidents that may occur during shipping.
The Organising Company may not be held responsible for the use or trade of the prizes as carried out by the winner(s).
ARTICLE 6
OVERSIGHT AND DISCLAIMERS
The Organising Company reserves the right, in particular in the event of force majeure, to truncate, extend, suspend, modify or cancel the game.
These changes shall, nonetheless, be announced in advance by all appropriate means.
The Organising Company’s liability shall not be incurred in the event of Internet dysfunction.
Participation in the Game implies that the features and limits of the Internet have been understood and accepted, in particular as regards technical performance, response time for viewing, questioning or transferring information, outage risks and, more generally speaking, risks inherent in Internet connections or transfers, and the lack of protection for certain data from possible misuse.
Consequently, the Organising Company may not be considered liable for the following (list not comprehensive):
· the sending and/or receiving of any data and/or information via the Internet;
· any dysfunction on the Internet preventing the game from running/working properly;
· failure in any receiving equipment or communication line;
· any loss of paper or electronic mail and, more generally speaking, any loss of data;
· problems with network overload;
· the operation of any software;
· the consequences of any virus, computer bug, anomaly or technical failure;
· any damage caused to a Participant’s telephone device;
· any technical, software or hardware breakdown whatsoever, preventing or limiting the ability to participate in the Game or having damaged a Participant’s system.
The Organising Company also reserves the right to perform any controls it deems timely.
Any participation not deemed compliant with the provisions set out in these Rules and Regulations, or containing incomplete participant information, shall not be taken into account.
In the event of dispute, proof of identity may be requested.
Participation in the game is strictly personal.
Should one of the winners be a minor, any winnings earned shall be entrusted to the of-age adult legally responsible for the minor. juridique.
The winner authorises the Organising Company, in advance and without any financial counterpart, to use his/her name, address or image for promotional or advertising purposes. This ability shall not, however, be construed as a responsibility placed upon the Organising Company.
Participation in this undertaking implies full and unequivocal acceptance of the rules herein.

Any attempted fraud during participation in this game shall entail legal action.
Any dispute that might arise with regard to the interpretation of the rules herein shall be expressly set before the organisers, the final arbiter of interpretation, and as a last resort, before the relevant PARIS courts of law.
Pursuant to the French Data Protection Act of 6 January 1978 (Article 17), the participants shall be entitled to access and correct data regarding them, by writing to:

ARTICLE 7
REIMBURSEMENT
The expenses incurred as a result of Internet connection may be reimbursed (on the basis of a flat fee calculated over an average connection time of 30 minutes maximum required to participate in the Game) solely by bank fund transfer, upon written request from the participant, in line with the procedure listed below, as may the postage fees arising from the said request.
The request must be written on paper, indicating, for verification purposes, the participant’s name, surname, mailing address and mobile telephone number, and must include:
· a bank identity slip (RIB),
· a photocopy of official ID (national identity card, passport),
· a photocopy of proof of residence (electricity, gas or telephone bill)
· and proof of Internet connection (bill).
This request must be postmarked from within 15 (fifteen) days, at the latest, following the end of the game session, and sent to the following address:

No request for reimbursement shall be taken into account unless it comes from a participant having taken part in the Game for which reimbursement of connection fees is being requested. All incomplete or illegible requests shall be disregarded.
Moreover, no reimbursement may be provided, by definition, unless the participant has actually disbursed payment, subject to legal action for fraud.
Participants not paying connection fees directly proportionate to their connection time (those with unlimited access subscriptions) may not request reimbursement, insofar as their connecting to the site does not give rise to any specific expenses.
